1. Introduction and acceptance

Welcome to BeBe Developmental Care.

These Terms and Conditions govern your access to and use of the website at https://bebedevelopmentalcare.co.za, including the purchase and use of our online courses, workshops, webinars, memberships, downloadable resources and related services.

By creating an account, submitting an order, selecting the acceptance box at checkout, accessing course material or using this website, you confirm that you have read, understood and agreed to these Terms and Conditions, together with our Privacy Policy and any additional terms displayed on the relevant course or checkout page.

If you do not agree to these Terms and Conditions, you should not purchase or access our courses or use our services.

2. About Bebe Developmental Care

“BeBe Developmental Care”, “we”, “us” and “our” refer to:

Bebe Developmental Care provides research based educational resources relating to infant and child development, early intervention, developmental care, sensory processing, feeding, regulation, sleep, parent education and related subjects.

3. Definitions

For purposes of these Terms:

  1. Course means any online course, programme, masterclass, workshop, webinar, membership, video, audio recording, presentation, written resource, downloadable document or other educational material supplied by us.
  2. Course page means the sales, information or registration page describing a particular Course.
  3. Course materials include all videos, recordings, presentations, diagrams, photographs, text, worksheets, handouts, checklists and downloadable resources forming part of a Course.
  4. Customer, User, you or your means any person who visits the website, creates an account, purchases or receives a Course, or uses any Course materials.
  5. Order means an offer submitted by you to purchase a Course or other product from us.

4. Eligibility and responsibility for your account

You must be at least 18 years old and legally capable of entering into a binding agreement to purchase a Course.

If you purchase a Course for another person, you confirm that you are authorised to do so and that the intended participant will comply with these Terms.

You are responsible for:

  • Providing complete and accurate registration information.
  • Keeping your username and password confidential.
  • All activity conducted through your account.
  • Informing us promptly if you believe your account has been accessed without permission.

Course access is intended for the registered purchaser only. You may not share your account or login details with another person.

5. Course information and what is included

The content, duration, access period, price and included resources for each Course will be described on the relevant Course page or checkout page.

Before purchasing, you are responsible for reviewing the Course description and ensuring that it is suitable for your needs.

Unless expressly stated otherwise, purchasing a Course does not include:

  • An individual assessment of you or your child.
  • Personalised occupational therapy, medical, feeding, psychological or developmental advice.
  • Diagnosis or treatment.
  • Individual email, WhatsApp or telephone support.
  • Guaranteed access to Elise Lecuona or another healthcare professional.
  • Continuing professional development points or formal accreditation.
  • Lifetime access to the Course.

Any live sessions, communities, bonuses or supplementary resources are subject to the specific terms stated on the Course page.

6. Orders and formation of the agreement

All Orders are subject to acceptance and successful payment.

An automated acknowledgement of your Order does not necessarily constitute final acceptance. The agreement becomes effective when:

  • Payment has been successfully received or an approved payment plan has been activated; and
  • We confirm your enrolment or provide access to the Course.

We reserve the right to decline or cancel an Order where:

  • Payment has not been authorised.
  • A price or Course description contained an obvious error.
  • We reasonably suspect fraudulent or unlawful activity.
  • The Course is no longer available.
  • Accepting the Order would breach any applicable law.

If we cancel an Order after receiving payment and you have not received or accessed the Course, we will refund the relevant amount.

7. Prices, taxes and payment

Prices are displayed in South African Rand unless otherwise stated.

The Course page or checkout page will indicate whether applicable taxes are included in the price.

Payment must be made through one of the payment methods offered at checkout. Payments may be administered by authorised third-party payment providers, and their terms and privacy practices may also apply.

We do not ordinarily store complete debit or credit card details on our website.

We may change Course prices at any time. A price change will not affect a purchase already confirmed, except where the displayed price was clearly erroneous.

Promotional prices, discount codes and bonuses:

  • May be available for a limited period.
  • May be subject to additional conditions.
  • Cannot ordinarily be applied retrospectively.
  • May not be exchanged for cash.
  • May not be combined unless we expressly allow it.

8. Payment plans

Where a payment plan is offered, you agree to pay every instalment on the dates shown at checkout.

A payment plan is a method of paying the full Course price and is not a monthly subscription that may be cancelled merely because you no longer wish to continue with the Course, unless the checkout page expressly describes it as a cancellable subscription.

If an instalment is declined or overdue, we may:

  • Contact you to arrange payment.
  • Attempt to process the payment again where authorised.
  • Temporarily suspend Course access.
  • Cancel access after reasonable notice.
  • Recover outstanding amounts to the extent permitted by law.

Suspension of access does not automatically cancel valid amounts already owing under an agreed payment plan.

9. Course access and availability

Course access begins once your payment or enrolment has been confirmed.

Unless a different period is stated on the Course page, access will be provided for 12 months from the date of enrolment.

Access is personal, limited, non-exclusive, non-transferable and revocable in accordance with these Terms.

We may occasionally need to suspend access temporarily for maintenance, security, updates or circumstances beyond our reasonable control. We will take reasonable steps to minimise interruptions.

We may update, reorganise or improve Course content, provided that this does not materially remove the central content purchased by you during your stated access period. You are responsible for ensuring that you have:

  • A reliable internet connection.
  • A compatible device and updated browser.
  • Software capable of opening the resources supplied.
  • Sufficient data and storage.
  • A functioning email address that you check regularly.

Your internet, equipment and data costs are your responsibility.

10. Refunds and cancellations

Because Courses contain digital content that may be accessed, viewed or downloaded immediately, refunds are not automatically available merely because you changed your mind, did not complete the Course, no longer require the Course or failed to use the access provided.

However, nothing in these Terms excludes or limits any right or remedy that you may have under the Consumer Protection Act, the Electronic Communications and Transactions Act or any other applicable law.

Where a statutory cooling-off right applies, it will be honoured in accordance with the applicable legislation.

By requesting or activating immediate access to a Course, you consent to the digital service and Course delivery beginning before the expiry of any potentially applicable cooling-off period. The legal effect of this consent will be determined in accordance with applicable South African law. A refund may also be considered where:

  • We are unable to provide the Course you purchased.
  • The Course is materially different from its published description.
  • A substantial technical problem within our control prevents access and we cannot resolve it within a reasonable period.
  • A refund is otherwise required by law.

To request assistance or a refund, contact info@bebedevelopmentalcare.co.za and provide:

  • Your full name.
  • The email address used for the purchase.
  • The name of the Course.
  • The purchase date.
  • A description of the problem.
  • Any relevant supporting information.

Approved refunds will ordinarily be made using the original payment method within a reasonable period.

Once a refund has been issued, your Course access will be terminated and you must stop using and delete any downloaded Course materials.

Any separate money-back guarantee offered for a particular Course will be governed by the conditions stated on its Course or checkout page.

11. Intellectual property and permitted use

All Course materials and website content are owned by or licensed to Bebe Developmental Care and are protected by copyright, trademark and other intellectual property laws.

Your purchase grants you a limited licence to access and use the Course materials for your own personal, non-commercial educational purposes.

Unless we have given prior written permission, you may not:

  • Copy, reproduce, republish or distribute Course materials.
  • Share your login or allow another person to access your account.
  • Record or screen-record Course videos, webinars or live sessions.
  • Upload Course materials to social media, cloud-storage folders, websites or file-sharing platforms.
  • Sell, sublicense, transfer or give the Course to another person.
  • Remove copyright notices, branding or watermarks.
  • Translate, adapt or create derivative resources from the Course.
  • Use our materials to create or present your own course, workshop, parent group, training programme or professional resource.
  • Use Course content for commercial or professional training purposes.
  • Use our name, logo or materials in a way that suggests endorsement or affiliation.

You may download and print resources specifically designated as downloadable for your own personal use and, where expressly stated, for use with your own child.

Purchasing a Course does not transfer ownership of any intellectual property to you.

12. Educational and healthcare disclaimer

Our Courses are provided for general educational and informational purposes.

Although Course content is developed with professional care and is intended to be evidence-informed, it cannot take account of every child’s medical history, developmental profile, feeding abilities, sensory needs, family circumstances or individual risks.

Course participation does not create a therapist–patient, doctor–patient or other healthcare-provider relationship between you, your child and BéBé Developmental Care or Elise Lecuona.

The Courses do not replace:

  • An individual occupational therapy or developmental assessment.
  • Medical examination, diagnosis or treatment.
  • Advice from your child’s paediatrician, doctor, occupational therapist, physiotherapist, speech-language therapist, dietitian, lactation consultant or other appropriately qualified healthcare professional.
  • Emergency medical care.

You should obtain individual professional advice before implementing activities where your baby or child:

  • Was born prematurely or has ongoing medical needs.
  • Has feeding, swallowing, breathing or growth concerns.
  • Has developmental delay or neurological concerns.
  • Has a diagnosed medical or developmental condition.
  • Shows pain, distress or an unexpected reaction.
  • Has needs that make a general activity potentially unsuitable.

If you are concerned about your baby’s or child’s health or safety, contact an appropriately qualified healthcare professional. In an emergency, contact the relevant emergency services immediately.

Do not delay seeking professional assistance because of information contained in a Course.

13. Parent and caregiver responsibility

You remain responsible for deciding whether an activity is suitable for your baby or child and for providing appropriate adult supervision.

Activities must be adapted to your child’s age, developmental level, health, abilities and responses. Stop an activity if your child shows pain, breathing difficulty, colour change, choking, marked distress, unusual tiredness or any other concerning response, and seek appropriate professional assistance.

Never leave a baby or young child unattended while following Course activities.

Any discussion of sleep, positioning, feeding, bathing, massage, handling, movement, sensory activities or equipment must be considered together with current safety guidance and advice from your child’s own healthcare team.

14. No guarantee of outcomes

Each child and family is different. Developmental, feeding, sleep, regulation and parenting outcomes depend on many factors outside our control.

We do not promise or guarantee that:

  • A child will achieve a particular developmental result.
  • Feeding, sleep or regulation difficulties will resolve.
  • Course participation will prevent a developmental or medical condition.
  • A particular method will be suitable or effective for every baby, child or family.
  • You will achieve the same results as another participant or testimonial.

Testimonials represent individual experiences and are not guarantees of typical or future outcomes.

15. Live sessions and community participation

Where a Course includes live sessions, comments, discussion groups or an online community, you agree to communicate respectfully and not to post:

  • Abusive, discriminatory, threatening or unlawful material.
  • Advertising, spam or unrelated promotional content.
  • Confidential information about another person.
  • Photographs, recordings or personal information concerning a child unless you are legally authorised to share them.
  • Content that infringes another person’s rights.

You must respect the privacy of other participants. You may not record, screenshot, copy or distribute another participant’s contributions without their express consent.

Community discussions do not constitute individual healthcare advice. Statements made by participants are their own and are not necessarily endorsed by BéBé Developmental Care.

We may moderate or remove content and may suspend community access where these rules are breached.

16. User submissions and questions

If you submit a question, comment, photograph, video, testimonial or other material, you confirm that:

  • You are entitled to submit it.
  • It does not violate another person’s rights.
  • Any required permission has been obtained.
  • The information supplied is accurate to the best of your knowledge.

Please do not submit confidential clinical records or unnecessary identifying information about a child through public comments, course communities or social media.

We will not use an identifiable photograph, video or testimonial for public marketing without appropriate consent.

17. Privacy and protection of personal information

We process personal information in accordance with our Privacy Policy and applicable South African data-protection legislation, including POPIA.

Information may be processed for purposes including:

  • Creating and administering your account.
  • Processing payment.
  • Delivering Course content.
  • Communicating service and access information.
  • Providing technical support.
  • Meeting legal, accounting and security obligations.
  • Sending marketing communications where permitted.

Because information concerning children and health may be sensitive, you should provide only information reasonably necessary for the relevant purpose.

Our Privacy Policy should explain what information is collected, why it is collected, the parties with whom it may be shared, how long it is retained, how it is protected, and how you may exercise your data-protection rights.

18. Third-party platforms and links

We may use third-party providers for website hosting, learning management, video hosting, email delivery, analytics, payment processing and other services.

Your use of a third-party platform may also be subject to that provider’s terms and privacy policy.

Links to third-party websites are provided for convenience. We do not control or accept responsibility for their content, availability, security or privacy practices.

19. Acceptable use and suspension

You may not:

  • Use the website or Course for an unlawful or fraudulent purpose.
  • Attempt to bypass Course security or access restrictions.
  • Introduce malware or harmful code.
  • Scrape, harvest or systematically extract website or Course content.
  • Interfere with the website, platform or another user’s access.
  • Misrepresent yourself or impersonate another person.
  • Infringe our intellectual property or the rights of another party.

We may suspend or terminate access where we reasonably believe that these Terms have been materially breached. Where appropriate, we will provide notice and an opportunity to remedy the breach.

Termination for a material breach does not entitle you to a refund except where required by law.

20. Limitation of liability

To the fullest extent permitted by law, BéBé Developmental Care will not be liable for indirect, special or consequential loss arising from your use of, or inability to use, the website or Course materials.

We are not responsible for loss caused by:

  • Your failure to follow relevant safety guidance.
  • Using general Course information instead of obtaining necessary individual professional advice.
  • Your internet connection, device or software.
  • A third-party platform or service outside our reasonable control.
  • Events beyond our reasonable control.

Nothing in these Terms excludes or limits liability where such exclusion is prohibited by law, including liability arising from gross negligence or any rights that cannot lawfully be waived under consumer-protection legislation.

21. Indemnity

To the extent permitted by law, you agree to be responsible for losses or claims arising from:

  • Your unlawful use of the website or Course.
  • Your unauthorised copying or distribution of Course materials.
  • Content submitted by you that infringes another person’s rights.
  • Your material breach of these Terms.

This clause does not require you to indemnify us for our own unlawful conduct, gross negligence or liability that cannot legally be excluded.

22. Changes to Courses

We may make reasonable changes to Course materials to:

  • Correct errors.
  • Improve clarity or presentation.
  • Update information.
  • Reflect changes in professional knowledge, guidance or technology.
  • Replace an unavailable platform or service.

If we discontinue a paid Course before the end of the promised access period, we will take reasonable steps to provide continued access, replacement material or another appropriate remedy.

23. Changes to these Terms

We may update these Terms to reflect changes in our services, technology or applicable law.

The version applicable to your purchase will ordinarily be the version presented or linked at the time of purchase. Material changes will not retrospectively remove rights already granted to you unless required by law.

The latest version will be published on our website with its effective date.

24. Complaints and dispute resolution

If you have a complaint, please contact us first at info@bebedevelopmentalcare.co.za so that we can attempt to resolve it promptly and fairly.

These Terms are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with by a court or recognised dispute-resolution body having jurisdiction under South African law. Nothing in these Terms prevents a consumer from approaching an appropriate consumer-protection body or exercising any other statutory right.

25. General provisions

If any provision of these Terms is found to be unlawful or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue to apply.

A failure or delay by us in enforcing a provision does not amount to a waiver of that provision.

You may not transfer your rights or Course access to another person without our written permission. We may transfer the administration of the website or Courses to a successor or service provider, subject to applicable law and data-protection requirements.

These Terms, the relevant Course page, the checkout information and our Privacy Policy constitute the agreement relating to your purchase.
